Family Check-Up Online User Agreement

By using Family Check-Up® Online (FCUO) you are agreeing to this Family Check-Up® Online User Agreement (User Agreement) between you, or your agency if acting in the scope of your employment, and Northwest Prevention Science Inc (NPS). Within this User Agreement, references to “you” may mean your agency and you personally, if applicable. NPS reserves the right to update this User Agreement at any time and its sole discretion. Use of the FCUO and this website is limited to individual users (parents, clinicians, or administrators) for the purpose of engaging Family Check-Up® activities. You may not link to this website for your own use, may not publish the contents of this website, nor use of any UO or NPS names, identifiers, or marks in advertising with other products. FCUO is not designed for use across multiple agencies and if you are accessing this website on behalf of an agency, you represent and warrant that you are doing so for clients of your agency. FCUO may change based on research or feedback provided by users, and therefore, is to be used 'AS IS'. FCUO is a web-based application designed to support professional clinicians, therapists and case workers who have already received training in the implementation of the Family Check-Up® (FCU) program. Use of FCUO without prior training and without appropriate supervision by a Certified FCU Supervisor is at the sole discretion of the licensing agency and may not be considered to constitute an evidence-based program for the purposes of seeking reimbursement for services rendered. The content of FCUO needs to be supplemented with other information and professional judgment in making clinical decisions that enhance family outcomes. Data Use
In order to create an account, FCUO requires that all users create a profile, which is stored on the site, and collects personal information such as name, email, telephone number (optional), a profile picture, or other information. NPS maintains all data provided on secure servers. Access to your account's Data is protected and restricted to those Page 2 of 3 individuals with a legitimate need to know in order to deliver the FCUO. NPS does not release the Data without your written permission, except as required by law, regulation, subpoena, or administrative process. It is your responsibility to maintain security of login credentials. NPS does not sell, share, rent or trade personal information with any third parties other than as disclosed in the privacy policy. NPS also does not share, sell, rent or trade adult or student's personal information with third parties other than as disclosed within this privacy policy. However, we may share de-identified and/or aggregated data with others for their own uses, including but not limited to the University of Oregon (UO). Your Responsibility
Regarding Use of FCUO It is your responsibility not to disclose your activation code, user name and password to anyone. It is your responsibility to use FCUO only for the purpose for which they were intended. Any use of FCUO not in accordance with the intended purpose is prohibited. NPS does not provide a service to send your data to you when you decide to end your use of FCUO or when NPS ceases to provide FCUO. However, NPS ensures that your data are available for sixty (60) days after you close your account or NPS announces that it will no longer provide access to FCUO, so that an orderly transition can be made.
Risk
Nothing contained in this Agreement confers any right to use in advertising, publicity or other promotional activities any name, trade name, trademark, or other designation of NPS, FCU or FCUO without the express written permission of NPS. You agree not to deep-link to the FCUO website for any purpose, unless specifically authorized by NPS. NPS makes no representations or warranty on the accuracy, validity, completeness, or availability of information or results obtained from FCUO. NPS reserves the right make modifications or improvements at any time without notice. You agree that, if you provide FCUO feedback to NPS, NPS are permitted to use this information in making changes to FCUO and use of your feedback does not entitle you to any rights in or claims to such changes. You acknowledge that FCUO is solely an implementation support resource and is made available 'AS IS,' without obligation by NPS to provide accompanying services or support. You acknowledge and agree as a condition of using FCUO, that the information obtained from FCUO is intended as a supplement to, and not a substitute for, your knowledge, expertise, skill, and professional judgment in making decisions to adjust and enhance outcomes for families.
NPS EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES REGARDING FAMILY CHECK-UP ONLINE, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES PERTAINING TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NPS WILL NOT BE LIABLE DIRECTLY OR INDIRECTLY FOR ANY PROPERTY DAMAGE, PERSONAL INJURY, LOSS OF USE, INTERRUPTION OF BUSINESS, LOSS OF PROFITS, OR OTHER SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, HOWEVER CAUSED, WHETHER FOR BREACH OF WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE.
(Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so this exclusion and limitation may not apply to You). By using FCUO, you grant NPS the right to use any de-identified data any user associated with your agency enters into FCUO for any purpose. You also grant the NPS the right to use data entered into FCUO for the improvement and maintenance of FCUO, and for research, provided such research use of data is approved by an institutional review board regulated by the Office for Human Research Protections within the United States Department of Health and Human Subjects. No data transmission over the Internet can be guaranteed to be 100% secure and "hacker-proof," and FCUO cannot ensure or warrant the security of any information managed by the site, whether transmitted to FCUO by you, your agency, or your clients. NPS shall not be liable if a security breach occurs, if the site malfunctions, or if information is misused or mismanaged in any way to your detriment or the detriment of a third party, whether by FCUO, your agency, your client, or an unauthorized third party.
